At pingyou Inc., ("the Company", "We"), we attach great importance to your privacy and the security of your personal data. This Privacy Policy explains how your data is collected, used, shared and protected when you use the pingyou platform (the "Service").

This Policy has been prepared in compliance with Turkish Law No. 6698 on the Protection of Personal Data ("PDPL") and the related legislation, as well as the Meta (Facebook/Instagram) Platform Policies.

2. INFORMATION WE COLLECT

In order to provide our Service, we collect and process the following categories of data:


2.1. Account and Membership Information

Information you provide when you register for our Service:

  • Name, surname, e-mail address, telephone number.

  • Company information (trade name, tax office, tax ID).

  • Invoicing and payment information (credit-card data is not stored by us; it is processed by the licensed payment institutions Iyzico/Stripe).


2.2. Meta (Instagram/Facebook) Data

When you connect your social media accounts in order to use our Service, we access the following data via the Meta Graph API:

  • Profile Information: Instagram/Facebook username, profile picture, biography.

  • Communication Content: Direct Messages (DMs) you receive, posts and post comments, stories and story replies.

  • Engagement Data: Messaging timestamps, frequency of engagement.


IMPORTANT NOTE: pingyou Inc. does not permanently store DM content or user messages. Such data is processed solely for the purpose of real-time analysis (intent detection) and response generation, and is deleted from our systems or anonymized once the operation is complete.


2.3. Usage and Technical Data

  • IP address, browser type, device information.

  • Log records (login times, transaction history).

  • Data collected via cookies.


3. HOW WE USE YOUR DATA (PURPOSES OF PROCESSING)

We use the data we collect for the following purposes:

  • Provision of the Service: analyzing incoming messages, generating AI-assisted response drafts and operating automation rules.

  • Customer Support: resolving technical issues and responding to your requests.

  • Security: protecting your account against unauthorized access and detecting suspicious activity.

  • Legal Compliance: fulfilling the requirements of the PDPL, Law No. 5651 and the Meta Platform Policies.

  • Product Development: conducting statistical analyses on anonymized data to improve user experience.


4. DATA SHARING AND TRANSFER

We never sell your personal data to third parties. We share your data only in the following circumstances:

  • Service Providers (Sub-processors): trusted partners providing technical infrastructure for the delivery of our Service (e.g., AWS/Google Cloud for hosting, Stripe for payments, OpenAI, Google and Anthropic for AI models). These providers process data only upon our instructions and under confidentiality agreements.

  • Legal Obligations: sharing with competent public authorities where required by a court order, prosecutor's request or legal obligation.

  • Business Transfer: in case of a merger or sale of our Company, your data may be transferred to the new owner (in such case, you will be notified in advance).


5. SPECIAL PROVISIONS REGARDING META PLATFORM DATA

We are fully compliant with the Meta Developer Policies:

  • No Surveillance: we do not use your data to conduct surveillance on users.

  • No Profiling: we do not engage in profiling without users' consent.

  • Data Retention: we do not retain data obtained from Meta for longer than necessary for the Service. When you delete your account or disconnect, the relevant Meta data is immediately deleted from our systems.


6. DATA SECURITY

We implement industry-standard security measures to protect your data:

  • SSL/TLS encryption on all data transfers.

  • Authorization matrices and firewalls for database access.

  • Regular security scans and penetration tests.

However, please note that no data transmission over the internet can be guaranteed to be 100% secure.


7. COOKIES

We use cookies on our website to improve your experience.

  • Strictly Necessary Cookies: required for the site to function (login, etc.).

  • Analytics Cookies: help us understand how the site is used (Google Analytics, etc.).

You can block cookies at any time through your browser settings.


8. YOUR RIGHTS (ARTICLE 11 OF THE PDPL)

Under the PDPL, you have the following rights:

  • To learn whether your personal data is being processed.

  • To request information regarding such processing if it has occurred.

  • To learn the purpose of the processing and whether the data is being used in line with that purpose.

  • To know the third parties to whom the data is transferred domestically or abroad.

  • To request rectification if the data is incomplete or inaccurate.

  • To request erasure or destruction of the data when the legal conditions are met.

You may exercise these rights by sending an e-mail to support@pingyou.ai. Your request will be responded to within thirty (30) days at the latest.


9. CHANGES

We may update this Privacy Policy from time to time. We will notify you by e-mail or via the platform of any material changes.


10. GOVERNING LAW AND JURISDICTION

This document shall be governed by and construed in accordance with the laws of the Republic of Türkiye. Any dispute arising out of or in connection with this document shall be subject to the exclusive jurisdiction of the Istanbul (Çağlayan) Courts and Execution Offices of the Republic of Türkiye.
